INTRODUCTION

At OneClick Data, Inc  (referred to throughout as “OneClick,” “work,” or “us,” “we,” “our,” etc.), we respect your privacy and are committed to protecting it through our compliance with this policy.  This privacy policy, discloses what information OneClick gathers about you through our website http://www.oneclickcode.com, any sub-domains thereof, API integrations or widgets we offer, any email, messaging, applications, or any of the services or features accessible therein, and any other website or web pages we own or operate that include a link to this statement and any services provided through our website (collectively, the “Website”) and when you use our applications, such as CODE REPORTS, and any services provided through our applications (collectively the “App”), however accessed, and discloses how that information is used.  The services provided through the Website and the App by OneClick are collectively the “Services”.  OneClick owns and operates the Website and App, and we use the information we receive from them as described below.  We do not sell your personal information.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it.  If you do not agree with our policies and practices, your choice is not to use our Website or App.

USING THE WEBSITE AND/OR APP AND SHARING YOUR INFORMATION WITH US, YOU CONSENT TO AND ACCEPT THE PRIVACY PRACTICES DESCRIBED IN THIS PRIVACY POLICY. YOU ALSO REPRESENT AND WARRANT THAT YOUR USE OF THE WEBSITE AND/OR APP ARE FOR COMMERCIAL OR EMPLOYMENT USE ONLY AND NOT FOR INDIVIDUAL OR HOUSEHOLD USE.

ONLINE AND MOBILE INFORMATION PRACTICES

We are committed to protecting your personal privacy as you visit our Website and/or App. Accordingly, this Privacy Policy informs you how we collect and use your information on our Website and through our App. If we make material changes to this Privacy Policy, we will indicate that by changing the modification date below.

INFORMATION WE MAY COLLECT

The information we collect varies depending on the type of activity you are performing on our Website or App and helps us personalize and continually improve your experience.  Much of the Website and App can be accessed without providing any personal information. In all instances where we collect personal, financial, or other information through the Website and/or App, we specifically indicate that that information is being collected in order to provide you with the product or service you have requested.

  1. Information You Provide to Us.

Registration Information. When you sign up for an account or use the services, you give us your name, email address, phone number, credit card information, business information, date of birth, password, account information and any other information deemed relevant.  If you decide to sign up for the Services through your place of business or through a third party account, we will also get basic information from that third party profile, which may include like your name, gender, profile photo, and contacts.

Of course, you’ll also provide us whatever information you send through our Services, such as uploads, comments, messages, etc.  Keep in mind that communications with other users of our Services can always be used by those users.  So, the same common sense that applies to the internet at large applies to OneClick as well.

Information from Third Parties. We may collect and receive information about you, including personal information and financial account information, from third parties, such as financial institutions and our service providers, for identity verification, fraud protection, risk assessment, payment processing, account management, and other purposes.  We may collect your business information from credit bureaus for the foregoing purposes as well.  In addition, we may receive demographic information about you from third parties to help us better understand our users and to improve and market our Services.

Single Sign-On Information. Single Sign-On allows you to sign in to the Services from another service you use and with which we partner.  We will collect certain information for security purposes in order to verify your authorized access to the Services, including your username and password for the other service.

Payment Method. When you add a credit card, bank account, or payment method to your account, a third party that handles payments for us will receive your card information.  To keep your financial data secure, we do not store full credit card information on our servers.

Communications. If you contact us directly, we may receive additional information about you. For example, when you contact our customer support team, we will receive your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide. 

  1. Information We Collect When You Use the Services.

As is true of most websites and apps, we automatically collect certain information when you visit our Website or use the App. This information includes:

Location information.  This is the geographic area where you use your computer and mobile devices (as indicated by an Internet Protocol “IP” address or similar identifier) when interacting with our Website, App, and/or Services.  We may collect precise location data from your device when the App is running in the foreground or background.  If you label certain locations, such as “home” or “work,” we receive that information too. Your location information is necessary in order for us to provide the Services.

Log data.  As with most websites and technology services delivered over the internet, our servers automatically collect data when you access or use our Website, App, and/or Services and record it in log files.  This log data may include the IP address, browser type and settings, the date and time of use, information about browser configuration, language preferences, and cookie data.

Usage information.  This is information about the Website or Services you use and how you use them. We may also obtain data from our third-party partners and service providers to analyze how users use our Website and Services.  For example, we will know how many users access a specific page on the Website and which links they clicked on. We use this aggregated information to better understand and optimize the Website.

Device and Phone Book information.  These are data from your computer or mobile device, such as the type of hardware and software you are using (for example, your operating system and browser type), the application installations, operating system, phone carrier and manufacturer, mobile advertising identifiers, push notification tokens, as well as unique device identifiers for devices that are using our software.

Location and Quotes.  Many of our Services require us to collect location data and other information in order to provide code information.

Cookies.  A cookie is an element of data that a website can send to your browser, which is then stored on your system. A cookie is useful for having the browser remember specific information across several pages or between visits to a website. A cookie does not store personally identifiable information or any sensitive information. Also, our site does not read any information stored in cookies given to you from other websites, except in cases where the other website is a provider of information or functionality within our website and that cookie is necessary to make our website function correctly.  Our website makes use of cookies for the following purposes: website administration and personalization; authentication; completing your request; and analysis of page and website information that does not identify specific individuals.  You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether to accept it.  Browsers may also be set up to display a warning when a cookie is used.  You may even disable your browser from accepting cookies.  In order to provide you with the best possible experience while visiting our website, please enable cookies within your browser. Some portions of our website may not function properly if cookies are disabled.

Google Analytics.  We use a tool called "Google Analytics" to collect information about use of this site across devices.  We have implemented the Remarketing and AdWords features of Google Analytics.  The Remarketing feature allows us to serve you relevant advertising on third party websites if you have visited our Website, however accessed, but does not personally or directly identify you. AdWords allows us to manage our advertising and collect information about your visit to our Website.  Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Ad Settings.  You can opt out of Google Analytics without affecting how you visit the Website.   • Mobile Location Services

An App may utilize location services on your mobile device to collect and use location data, including the real-time geographic location of your device.  If you consent to the App’s utilization of location services, we may use GPS, Bluetooth, your device’s unique identifier, and/or your IP Address, along with Wi-Fi and cell tower locations, and other technologies to determine your device’s geolocation.  In addition, photographs taken by your mobile device may contain metadata indicating the location the photograph was taken, and submission of such photographs to us as part of requesting Services will provide us such location information.  This location data is utilized to deliver services requested by you.  We will collect geolocation data only if you consent by actually submitting such information to us by providing us such information in a submission for request for Services or by providing photographic images containing location data.  We do not maintain a history of the location of a device, only where your device is at any given moment.  You may choose to disable location services through our App or your mobile enabled Wi-Fi devices, but if you do so, you will not receive any Services that require a geolocation using such technology. Most mobile devices provide users with the ability to disable location services.  These controls are generally located in the device’s settings menu. You can also contact your mobile service carrier or your device manufacturer for more information on disabling location services.

  • Cross-Context And Cross-Device Collection, Identification, And Personalization

We merge data collected from our Website and our Apps.  That data could include cookie IDs, device advertising IDs and/or device IDs, transactions and browsing history, email address, and/or any other information you have entered on our Website or App.  This combination of data helps us identify you, improve your experience, and create a more personalized setting.  We may also link your various devices so that the content you see on one device is the same as that seen on another one of your devices.

HOW WE USE YOUR INFORMATION

We use, process, and store your information as necessary to perform our contract with you and for our legitimate business interests, including:

  1. to help us administer our Website, App and Services, transactions, code information, location sharing, and other related evaluation and code related services, as well as to authenticate users for security purposes, provide personalized user features and access, process transactions, conduct research, develop new features, and improve the features, algorithms, and usability of our Website or Services.
  2. to communicate with you about your use of our Website, App, product announcements, and software updates, as well as respond to your requests for assistance, including providing account verification support if you’re having difficulty accessing your account.
  3. to send you direct marketing emails and special offers through our Website, App or email, from which you can unsubscribe at any time. For more information, please see the section entitled, “How do email communications work?”
  4. to display user content and information associated with your account and make sure it is available to you when you use our Services.
  5. to administer the promotions and marketing events you have entered in order to serve you and connect you with our events.
  6. to communicate with you about your account and/or our products and services and for other transactional or informational purposes
  7. in relation to billing, invoicing, and collection activity
  8. In any other way we may describe when you provide the information.

Phone Number Use.  By providing your phone number above (mobile or otherwise), you agree that we may call or text you at that number about your account or for any other transactional or informational purpose using automated dialing technology.


CODE CALCULATIONS FEATURES AND INTEGRATIONS

The Services may offer connections to third party features and other integrated tools which let you share actions you take on our Services with other media, and vice versa.  The use of such features enables the sharing of information in order to provide the code information in accordance with our Services.  If you post or communicate through our Services, such messages, posts, images, videos, and content will become available to other users and third parties. If there are third-party features integrated with our Services they may also share or post the information you provide by posting or further sharing.  For more information about the purpose and scope of data collection and processing in connection with third party features, please visit the privacy policies of the entities that provide these features.

Additionally, you may give certain third party apps different levels of permissions to interact with your account to take advantage of things location evaluation or code configuration.  If you want to stop using one of these apps and revoke your permission, please contact us at code@OneClickCode.com.

COOKIE AND TRAFFIC DATA

Some content or applications, including advertisements, on the Website or App may be served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website.  The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services.  They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. By using this service we are able (for example) to see how many people visited a given page or clicked on a given link.  This information helps us optimize the performance of the Website.

We do not control these third parties’ tracking technologies or how they may be used. IS MY INFORMATION KEPT CONFIDENTIAL?

For any information you provide to us, except as otherwise provided in this Privacy Policy, we will keep your personal data private and only share it with other third parties when:

  1. Service Providers. We use service providers who assist us in meeting business operation’s needs, including hosting, delivering, and improving our Services.  We also use service providers for specific services and functions, including email communication, customer support services, and analytics. These service providers may only access, process, or store personal data pursuant to our instructions and to perform their duties to us.
  2. Consent. We have your explicit consent to share your information.
  3. Law Enforcement. Occasionally we may be required by law enforcement or judicial authorities to provide information, including personal data, to the appropriate governmental authorities. We will disclose personal data upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.
  4. Safety. We determine that the access, preservation, or disclosure of your information is required by law to protect the rights, property, or our personal safety and that of users of our Website, or to respond to lawful requests by public authorities, including national security or law enforcement requests.
  5. Business Transaction.  We need to do so in connection with a merger, acquisition, bankruptcy, reorganization, sale of some or all of our assets or stock, public offering of securities, or steps in consideration of such activities (e.g., due diligence). In these cases some or all of your information may be shared with or transferred to another entity, subject to this Privacy Policy.
  6. Marketing, and Other Organizations.  We may provide general anonymous user data (e.g., the city, or the state, in which a device is located) and information about your surveys, interactions, individual user data, or code evaluation history to third parties that want to use the data to provide and create new solutions, subsidies and programs. This general data may be used to provide you with marketing opportunities to participate in these programs and improve service offerings, experiences, code information and other interactions. Unless we have your permission, we will only provide such parties with non-personally identifiable information. In other words, while this information may be provided in conjunction with a randomly assigned number, or a number assigned to your account, it will not be provided in conjunction with your name.

HOW SECURE IS MY INFORMATION?

Please keep in mind that while we take reasonable precautions to safeguard your information no amount of protection can guarantee its security. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

As we deem appropriate and as required by the applicable law, we use security measures appropriate for the sensitivity of the information, including personal data, and consistent with industry standards, including physical, organizational and technological protections, such as firewalls, to protect your personal data. We also use industry standard encryption technology to protect credit card and password information. However, since no security system is impenetrable, we cannot guarantee the security of our databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet.

If we learn of a security system breach, we may attempt to notify you and provide information on protective steps, if available, through the email address that you have provided to us or by posting a notice on the Website and/or through the App. Depending on where you live, you may have a legal right to receive such notices in writing.

HOW DO EMAIL COMMUNICATIONS WORK?

We send out various emails to clients and others who interact with the Website and App, such as emails about new blog posts, product releases or special events or promotions (“Marketing Emails”). Customers and other individuals that register with the Website or through the App will automatically be subscribed to receive certain Marketing Emails. Aside from those registering with the Website, you must opt in to receive Marketing Emails.

Marketing Emails contain an unsubscribe option which you can follow at any point if you wish to stop receiving some or all of the Marketing Emails. If you have received our Marketing Emails mistakenly, or wish to stop receiving them, you can also contact us at code@OneClickCode.com and we will remove you from our list.

The Website and App may also allow third parties to send various transactional (e.g. communications, questions, and other messages etc.) and outreach emails (together “Client Emails”). Unless such Client Emails are subject to an exception as part of an ongoing commercial relationship, or otherwise, as required by CANSPAM, they will contain an unsubscribe link.

For EEA users: We only send marketing communications to users located in the EEA with your prior consent. Please see the section “For EEA users” below.

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the information you provide to us. We have created mechanisms to provide you with the following control over your information:

Tracking Technologies and Advertising.  You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

Disclosure of Your Information for Third-Party Advertising.  If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by emailing us at code@OneClickCode.com

Promotional Offers from the Company.  If you do not wish to have your contact information used by the Company to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to code@OneClickCode.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, Service experience or other transactions.

Targeted Advertising.  If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by emailing us at code@OneClickCode.com.

HOW LONG WILL WE HOLD YOUR DATA?

We only store the information we collect about you for as long as is necessary to fulfill the purpose(s) for which we originally collected it. We may retain certain information for legitimate business purposes or as required by law.

HOW CAN I DELETE OR CORRECT MY PERSONAL DATA?

If you have created a profile and provided information through the Website or App, you can update your information by clicking on “Account Settings” which is accessible at the top of your screen once you’ve logged in. You can remove your personal data from your profile at any time by sending an email to (code@oneclickcode.com) and request that your account be “deleted”. 

CALIFORNIA PRIVACY RIGHTS/DO NOT TRACK

California residents visiting our Website may request that we not automatically gather and track information pertaining to their online browsing movements across the Internet.  Such requests are typically made through Web browser settings that control signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third-party websites or online services.  We do not currently utilize the capability to respond to web browser do not track signals or other mechanisms that provide you with the ability to exercise choice regarding the collection of this information.  

WHAT DO I DO IF MY DATA IS LOST OR STOLEN?

If you know, or suspect, that your credit card, account information, user name, or password has been lost, stolen or used without your authorization you need to contact us immediately (code@OneClickCode.com). Upon notification, we will take reasonable steps to mitigate any damage, which may have been caused. You are responsible for the safety and security of your user name and password. You should logout after each session you have with the Website and you shouldn’t share this information.

LINKS TO OTHER WEBSITES

Because our Website is secure, your browser URL will inform you if you are leaving a secured portion of the Website.  We strive to ensure that any information you send us is safe.  When you leave this Website and go to another linked site, we are not responsible for the content or availability of the linked site. Please be advised that we do not represent either the third party or you, if you enter into a transaction on the third party site. Further, the privacy and security policies of the linked site may differ from those practiced by us.  We are not responsible for the practices of any partners or resellers including those who have a link on our Website or App.  

GEOGRAPHICAL USES

FOR USERS IN SWITZERLAND OR THE EUROPEAN UNION OR OTHER LOCATIONS OUTSIDE THE UNITED STATES

INTERNATIONAL TRANSFER OF INFORMATION COLLECTED

OneClick stores personal information in the United States.  We do not provide Services to locations outside the United States and do not envision the offering services to individuals outside the United States.  If you provide us information, it will be transferred to and accessed in the United States.  This Privacy Policy shall apply even if we transfer personal information from non-United States countries to other countries.

YOU AGREE THAT THE INFORMATION YOU PROVIDE AND SUBMIT VIA THE WEBSITE OR APP IS BEING SENT TO THE UNITED STATES OF AMERICA. YOU ARE INFORMED THAT THE UNITED STATES PRESENTLY DOES NOT HAVE AN ADEQUATE LEVEL OF PERSONAL DATA PROTECTION AS DETERMINED BY THE EUROPEAN COMMISSION’S ADEQUACY DECISION ON OCTOBER 6, 2015 (Case C-362/14) AND ARTICULATED IN THE EUROPEAN UNION’S GENERAL DATA PROTECTION REGULATION AND HAS NOT RECEIVED A SIMILAR DESIGNATION OF ADEQUACY BY ANY OTHER FOREIGN DATA PROTECTION AUTHORITY.  YOU AGREE TO THE TRANSFER OF YOUR DATA AND PERSONAL INFORMATION TO THE UNITED STATES, HOWEVER, TO BE USED IN ACCORDANCE WITH THIS PRIVACY POLICY.

CHANGES

We reserve the right to change or revise this Privacy Policy at any time to reflect changes in the law or our data collection and use practices.  New updates to the Privacy Policy will be posted to this Website so that you are aware of what information we collect, how we use it, and under what circumstances we disclose it.  Privacy policy changes will apply to the information collected from the date we post our revised privacy policy, as well as to existing information we hold.  The date the privacy policy was last revised is identified at the top of the page.  Your continued use of this Website, App or Services after we make changes is deemed to be acceptance of those changes.

You acknowledge that you may be monitored by OneClick when using this Website or App so that OneClick may protect company assets and information.  OneClick may employ outside, third parties to assist in this process. Should OneClick become aware of misuse of the company’s data, OneClick may report the misuser to the proper government authorities and OneClick may exercise any and all of its rights. For the purposes of this Privacy Policy, “misuse” includes but is not limited to: 1) failing to comply with all laws and government regulations concerning the use and application of the data; 2) failing to comply with any terms or conditions stated in the agreement with OneClick; or 3) using the Website and/or App in an unreasonable, inappropriate, offensive or unethical manner. By accessing the Website and/or App, all users you consent to being monitored by OneClick while using the Website or App.

You acknowledge and accept civil and/or criminal liability for any actions that violate the security of the Website and/or App and the intellectual property of the OneClick, including but not limited to: (1) accessing data not intended for such user or logging onto a server or account which user is not authorized to access; (2) attempting to probe, scan or test the vulnerability of the OneClick’s system or network or to breach the OneClick’s security measures; (3) attempting to interfere in any way with the Website and/or App of host, network or any other User or customer. For the purposes of this Privacy Policy, all you acknowledge that “interference” includes, but is not limited to: mail bombing, spamming, flooding, overloading or crashing the Website and/or App or submitting any programs or viruses to the Website and/or App. “Interference” also includes using any program to browse or interact with the Website and/or App that consequently disrupts the Website and/or App. OneClick retains any cause-of-action that may arise due to the conduct of you toward the Website and/or App and OneClick may pursue any and all legal actions and available remedies.

All information, data and additional provided through the Website and App is provided “as-is.” OneClick is not responsible for the accuracy, completeness, reliability, or usefulness of any information, material or accessed through OneClick. The user assumes all responsibility and risk that may arise from using the Website and/or App.
